HearthStead

Terms of service

Draft v1 · 1 November 2026 — pending solicitor review

These terms form the contract between you and HearthStead Learning Limited (in formation) [company number and registered office to be confirmed]. Please read them alongside our privacy notice. Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

1. Who can use HearthStead

Accounts may be opened only by adults aged 18 or over who have parental responsibility for, or the permission of a person with parental responsibility for, each child added. You are responsible for supervising your child's use and keeping your sign-in details secure.

2. What we provide

HearthStead is a home-education support tool: adaptive maths and English practice for Key Stages 2 and 3, a family learning record, and activity ideas. It supports, but does not replace, your responsibility under section 7 of the Education Act 1996 to ensure your child receives a suitable full-time education. Lesson content marked "awaiting specialist review" is new and may change.

3. Founding-family membership and payment

  • The founding-family rate is £9.99 per month, fixed for your first 12 months, for up to three children. After 12 months the then-current price applies; we will tell you at least 30 days before any change.
  • Places are limited to 50 families and offered in order of the waiting list.
  • Payments are taken monthly in advance by our payment provider, which may act as merchant of record. Prices include VAT where applicable.

4. Cancellation and refunds

  • 14-day cooling-off period: under the Consumer Contracts Regulations 2013 you may cancel within 14 days of subscribing for a full refund. If you ask us to start the service immediately, we may deduct a proportionate amount for use during that time.
  • After that, you can cancel at any time; your membership continues until the end of the paid month and is not renewed.
  • If the service is faulty or not as described, you have rights to a repair, re-performance or price reduction.

5. Acceptable use

You must not misuse the service, attempt to access other families' data, upload unlawful content or photographs that identify other people's children without permission, or reverse-engineer the service. We may suspend accounts that breach these terms, after notice where reasonable.

6. Your content and your data

You own your family's learning record and anything you upload. You give us a limited licence to store and process it only to provide the service. You can export or delete it at any time.

7. Availability and changes

We aim for the service to be available at all times but cannot guarantee it will be uninterrupted. We may improve or change features; if a change significantly reduces what you pay for, you may cancel and receive a pro-rata refund.

8. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We do not exclude liability for death or personal injury caused by negligence, fraud, or anything that cannot lawfully be excluded. We are not liable for business losses, as the service is for domestic and private use.

9. Ending the contract

You can close your account at any time from your settings. We may end the contract with 30 days' notice, or immediately for a serious breach, and will refund any prepaid amount for the unused period.

10. Complaints and disputes

Contact hello@hearthstead.co.uk [to be confirmed]; we aim to respond within 14 days. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may bring proceedings in your local courts.
